These Terms and Conditions ("Terms") govern your access to and use of SkiTracker (the "Service"), operated by Belknap Mountain Web Services ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Service

SkiTracker provides snowboarding activity tracking, performance statistics, and session history based on device sensors and location services.

Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to misuse the Service, including by attempting to interfere with operation, circumvent security, access other users’ data, or reverse engineer any portion of the Service.

Assumption of Risk

Snowboarding and skiing are inherently dangerous activities that can result in serious injury or death. You assume all risks associated with your activities and the use of the Service, including risks related to terrain, weather, snow conditions, obstacles, lift operations, and other skiers/riders.

No Safety Reliance

The Service is provided for informational and recreational purposes only. You must not rely on SkiTracker for emergency response, navigation, avalanche safety, rescue coordination, or any safety-critical decision-making.

Accuracy Disclaimer

Location and performance statistics may be inaccurate or incomplete due to factors including GPS signal loss, device limitations, terrain, weather, battery constraints, sensor drift, and network availability. All statistics are estimates.

Data and Deletion Requests

Session data may be stored server-side and associated with your account. If you wish to request account and associated data deletion, follow the instructions in the Privacy Policy or contact support via the website contact page.

Intellectual Property

The Service, including software, design, trademarks, and branding, is owned by Belknap Mountain Web Services and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted by law.

Termination

We may suspend or terminate access to the Service if you violate these Terms or misuse the Service.

Limitation of Liability

To the maximum extent permitted by law, Belknap Mountain Web Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of laws principles.
